          Resource Consents

           

          A resource consent is required if you are proposing the use or development of land that is not permitted or allowed for in the District Plan, or it doesn’t meet the standards for the zone that the property is within. Resource consent gives you, or a future landowner, permission to carry out an activity that would not otherwise be allowed.  For more information on resource consents, the Council has prepared a number of guidance notes to assist you, these are located on the right hand side of this page.

           

          The starting point in knowing if you need resource consent is the District Plan, which identifies those activities that require resource consent.

           

           

          Preapplication Discussion:

           

          The Planning Team can help you understand the Plan and what it means to your project, however we suggest that before you come and see us, you collect as much information as possible about what it is that you want to do, including (and most importantly) an address. The more information we have, the better we can explain the issues to you.

           

          It is important to note however that Planning staff cannot tell you what you should do, as they must remain objective. As such, in some cases it may be appropriate to obtain the services of a consultant or surveyor.

           


          Types of consent:

           

          There are two types of resource consent that can be applied for from Ashburton District Council.

           

          Land use consent allows you to carry out an activity, use and/or develop land.

           

          Subdivision consent allows you to divide your property into smaller lots or to adjust the boundary of a property.

           

          Environment Canterbury consents In some circumstances, you may also need resource consent from the Regional Council, Environment Canterbury. You can visit their website at www.ecan.govt.nz for more information.

           

           

          Other things to be aware of:

           

          National Environmental Standard for Assessing and Managing Contaminants in Soil to Protect Human Health


          This environmental standard (under the Resource Management Act 1991) came into force on 1 January 2012. This standard means that if your land is, or has been, used for a hazardous activity or industry and you want to subdivide or change the use of the land, or disturb the soil, or remove or replace a fuel storage system, you will need to comply with the National Environmental Standard for Assessing and Managing Contaminants in Soil to Protect Human Health (NES).

          Archaeological Authority


          If your site has had human activity prior to 1900 you should be aware that, as well as needing a resource or building consent, you may be required to apply for an “Archaeological Authority” from the New Zealand Historic Places Trust.

          Applying for a Resource Consent

           

          Assessment of environmental effects

           

          When you apply for resource consent you must complete an application form and provide an Assessment of Environmental Effects. This is a description of what effects the proposed use or development will or may have on the surrounding environment including neighbours (e.g. noise), their properties (e.g. shading) and the wider area (e.g. increased traffic).

           

          Affected party approval

           

          A proposed activity may have effects on neighbours and their approval can make the path to getting resource consent easier than what it may otherwise be. To find out more about getting approval from your neighbours (or other persons who may be affected) or if you have been asked for your approval, refer to the ‘Affected Persons form’ and Guide available to download from the ADC Forms webpage.

           

          Paying by internet banking

           

          Please include the name of the applicant and the resource consent number (if known). If you do know the resource consent number, please enter the letters "RC" in the reference field. This will enable to match your payment and prevent delays in processing your consent.

           

          Notified Applications for resource consent

          There are some applications for resource consent that may have significant effects on the surrounding area and the Council will normally invite comments from the general public. These are known as 'Notified’'  applications.

           

          When an application for resource consent is notified a link will be available on this page to view the application and to download a form for making a submission.
